Terms of Service

Welcome to The Love Star™! These Terms of Service ("Terms") govern your access to and use of the The Love Star™ mobile applications (iOS and Android), our website(s), services, and related content (collectively, the "Services"), including but not limited to social posting, online dating (including real-time messaging and voice messages), astrology services (including birth charts, saved charts for family, friends, and love interests, chart-to-chart compatibility, Ask AI birth chart questions, and transit forecasts), AI-generated insights, optional dating recommendations, and singles events. By creating an account, checking in to an event, purchasing a ticket, or using the Services in any way, you agree to these Terms in full, including the Release and Waiver of Claims (Section 12), Limitation of Liability (Section 13), Indemnification (Section 14), and Binding Arbitration and Class Action Waiver (Section 15). If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use The Love Star™. By using the Services, you represent and warrant that you meet this requirement. Age verification measures may be implemented to ensure compliance.

2. Account and Security

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately if you suspect unauthorized access.

You agree to provide accurate information and to keep your account details reasonably current. You are responsible for any activity that occurs through your account, including content you upload and messages you send.

You may sign in using email and password, email verification codes, or optional third-party authentication (such as Google or Apple). Third-party sign-in is subject to those providers' terms and policies in addition to these Terms.

3. User Content and License Grant

You may upload photos, messages, voice messages, birth details (including birth details you provide for saved charts), event feedback/notes, reactions, poll responses, or other content ("User Content") to facilitate matchmaking, astrology features, and social interactions. You retain ownership of your User Content, but you grant The Love Star™ a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, reproduce, publicly display, distribute, modify, and create derivative works of your User Content as necessary to operate, improve, and promote the Services.

If you submit User Content that includes another person's image, voice, or personal information (including birth details for saved charts), you represent that you have the necessary rights and permissions to do so.

This license survives the termination of your account solely for: (a) operating the Services and honoring prior shares, (b) security, compliance, dispute resolution, and enforcing these Terms, and (c) archival and promotional purposes where lawful.

4. The Love Star™ Content and Intellectual Property

All content created by The Love Star™, including proprietary astrology algorithms, compatibility scores, personality reports, synastry charts, event notes generated by the system, designs, text, graphics, and computer code (collectively, "The Love Star™ Content"), are the exclusive property of Zelo LLC. You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to view and use The Love Star™ Content solely for your personal, non-commercial use within the Services.

5. User Conduct, Content Standards, and Prohibited Behavior

By using the Services, you agree to adhere to these Community and Safety Guidelines. Any violation may result in account suspension or termination under Section 6.

1. Respect and Courtesy: Treat other users with respect. Harassment, hate speech, or disrespectful behavior will not be tolerated.
2. Safety and Boundaries: Seek consent and respect personal boundaries. Unsolicited explicit content or harassment will result in immediate action.
3. Profile Integrity: Provide accurate information. Fake profiles, impersonation, and deception are prohibited.
4. Content Appropriateness: All content must be appropriate for a social and dating environment. Explicit, obscene, or offensive content may be removed.
5. Responsible Usage: Follow local laws. Do not spam, solicit, or attempt to move users off-platform for harmful or deceptive purposes.
6. Reporting and Disputes: Report inappropriate behavior using in-app tools. Contact support for disputes; do not engage in public confrontations.
7. Maintenance: Keep the app updated to access new features and security enhancements.

6. Right to Deny Service

The Love Star™ reserves the right to suspend, ban, or terminate accounts at its sole discretion without notice for violations of these Terms or other inappropriate conduct.

7. Purchases and Payments

The Love Star™ may offer one-time purchases (for example, event tickets). Payment terms will be presented before purchase.

All payments are non-refundable unless required by law or expressly stated at the time of purchase. Event tickets are generally final and non-refundable (see Section 18.14).

We may use third-party payment processors and platform billing (such as Apple or Google). Your purchase may also be subject to the third party's terms and policies.

8. Online Dating, Messaging, and Real-Time Features

1. Mutual matches: Certain chat features may be available only after a mutual match or other eligibility criteria.
2. Opt-in dating: Dating can be enabled or disabled in settings.
3. Voice messages and media: You are responsible for all media you upload or send.
4. No background checks: The Love Star™ does not perform background checks on users.
5. Do not share sensitive information: Do not share financial, government ID, or other sensitive personal information with strangers online.
6. Real-time delivery is not guaranteed: Message delivery, read receipts, and notifications may be delayed or fail.
7. Event in-app chat: Mutual event matches open chat threads in the Messages tab.
8. Blocking, reporting, and enforcement: You may block or report users. We may remove content or suspend accounts at our discretion.

9. Social Posting, Polls, and Community Features

1. Visibility: Your social content may be visible to other users depending on the feature and your settings.
2. Moderation: We may remove or restrict content that violates these Terms or is harmful, misleading, unsafe, illegal, or otherwise inappropriate. We reserve the right to remove comments that are inaccurate, spammy, or not constructive.
3. No guarantees: We do not guarantee that content will be stored indefinitely or delivered without interruption.

10. Astrology, Saved Charts, and Compatibility

The Love Star™ provides astrology features for informational and entertainment purposes only. They do not constitute professional advice.

1. Your birth chart: Generated from birth details in your profile.
2. Saved birth charts: You may create up to ten saved charts for family, friends, or love interests. You represent that you have a lawful basis to provide another person's birth details.
3. Compatibility: Offered via the Compatibility tab, saved-chart comparisons, and in dating/events contexts. Family charts may omit certain metrics for platonic context.
4. Ask AI: AI-generated answers are interpretive and not a substitute for professional advice.
5. Transit forecasts: Informational and entertainment only.
6. Compatibility percentile: Provides statistical context; not a guarantee of relationship outcomes.

11. Disclaimers and Assumption of Risk

All content is for informational and entertainment purposes only. It does not constitute medical, legal, financial, psychological, or other professional advice.

1. Dating and Matchmaking Disclaimer: You assume all risk when using the Services and interacting with others.
2. Astrology and Compatibility Disclaimer: Compatibility between saved charts does not imply third-party consent unless they are also a user. You assume all risk when relying on astrology or compatibility features.

12. Release and Waiver of Claims

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the maximum extent permitted by applicable law, you fully release, discharge, and forever waive claims against Protected Parties (Zelo LLC, The Love Star™, affiliates, officers, directors, employees, agents, event organizers, hosts, venues, and others involved in providing or supporting the Services) arising out of or related to the Services, events, interactions with other users, personal injury, property damage, reliance on astrology or AI content, and related matters.

California Civil Code Section 1542 Waiver: If you are a California resident, you expressly waive the benefits of Section 1542 regarding unknown claims.

No Legal Action: Except as provided in Section 15, you agree not to commence legal action against Protected Parties; your sole remedy is binding individual arbitration where permitted by law.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

1. No warranties: The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
2. Cap on damages: Aggregate liability shall not exceed the greater of $100 USD or the amount you paid in the twelve (12) months preceding the claim.
3. Excluded damages: No liability for indirect, incidental, special, consequential, exemplary, or punitive damages where permitted by law.
4. Third parties: We are not responsible for acts or omissions of users, hosts, venues, or payment processors.
5. Essential purpose: These limitations are an essential basis of the bargain.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Protected Parties from claims arising out of your use of the Services, User Content, conduct, violation of these Terms, interactions with others, or infringement allegations.

15. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY.

1. Informal resolution first: Contact support@zelo.chat and attempt good-faith resolution for at least thirty (30) days.
2. Binding arbitration: Disputes shall be resolved by binding individual arbitration administered by JAMS in San Francisco County, California, applying California law.
3. No class actions: Claims may be brought only in individual capacity, not as class or representative proceedings.
4. Jury trial waiver: You waive any right to a jury trial for covered disputes.
5. Fee shifting: Frivolous claims may result in fee awards to the prevailing party.
6. Opt-out: Email support@zelo.chat with subject "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms.
7. Exceptions: Injunctive relief for IP abuse; small claims court where qualified.
8. Severability: If the class waiver is unenforceable, the arbitration agreement may be void and disputes resolved in San Francisco courts.
9. Survival: This Section survives termination of your account.

16. Data Deletion, Account Deletion, and Termination

You may delete your profile from within the app or by contacting support.

1. We will remove or de-identify your data within a reasonable period, subject to operational constraints.
2. Certain information may be retained for legal obligations, security, fraud prevention, or financial records.
3. Content shared with others may remain visible to those recipients.

17. Electronic Communications

By using the Services, you consent to receive communications electronically, including emails, push notifications, and in-app messages.

18. Event Attendance (Singles Events)

By attending events organized, hosted, promoted through, or facilitated via The Love Star™, you agree to these additional terms:

1. Feedback Sharing: Event feedback may be shared with attendees in matched and unmatched cases.
2. Use of the App at Events: Participation workflows should be conducted through the app when network conditions permit.
3. Media Consent: Attending may constitute consent to photos and videos for promotional purposes.
4. No Background Checks: Exercise discretion when sharing personal information.
5. No Financial Assistance: Do not provide financial assistance to attendees.
6. Behavioral Conduct: Inappropriate behavior may result in denial of access to future events.
7. No Business Promotion: Promoting your business without prior permission is not permitted.
8. Assumption of Risk: You voluntarily assume all risks associated with attending and interacting at events.
9. Event Release: You confirm the release in Section 12 as to hosts, venues, and related parties.
10. Limitation of Liability: Protected Parties are not liable for damages arising from event attendance where permitted by law.
11. Indemnification: You indemnify Protected Parties for claims arising from your conduct at events.
12. Right to Refuse Service: We may refuse admission or remove attendees at our discretion.
13. Emergency Situations: Staff or venue personnel may take reasonable safety actions; we assume no responsibility for outcomes.
14. Event Ticket Refunds: Ticket purchases are final and non-refundable except if Zelo LLC cancels the event, subject to the refund policy stated in the full Terms.

19. Changes to Terms

We may update these Terms periodically. Updates will appear at https://thelovestar.com/terms.html, and continued use of the Services constitutes acceptance of the updated Terms.
